How about DRS is allowed when the next higher ranked car is VISIBLE to the driver and either immediately in front, or seperated by just one backmarker. This can be done anywhere on the track.
That way you get all the fun of passing backmarkers still and all catch-up opportunities there.
You also get every car behind having a slight chance to overtake.
