I'm guessing they fall into the legality of regulations in exactly the same way that the 'finger tabs' added by Mercedes/Ferrari/Cadillac to their flap element, do.
Perhaps they provide different advantages to each car, the Redbull one looks like wanting to generate powerful vortices (apart from the extra frontal area) at the rear of the wing span itself, probably to encourage more attached flow on the low pressure side at lower speeds. Obviously not worrying about drag (direct/induced) at all.
