A fine would be what he got if he was found guilty of modifying/tampering with his own car. A competitors car is something substantially different.

Vettel put his foot on Hamilton's tyre and pressed down on it in parc ferme and no warning or anything at all was done. That is prescedent and you have 50 years of prescedent to go along with it, it doesn't matter what the rules say. Max cannot be given a severe penalty for what he did unless as you say, they make it up on the spot.
They can't even prove he did anything at all to the car, that caused anything to change.
