But if they don't penalise Mercedes they will be seen as 'desperate' for Merc to win it. So what is the 'fair' option

I would be surprised if there was anything in the rules prohibiting drivers from touching the competition's cars ...

If this only applies to #44 (I.e. not #77) it's pretty obvious toto's team is deliberately bending the rules a little too far. I would not be surprised if Mercedes steps in here to avoid damage to the brand.

So it looks like it's actually a pit lane start for the sprint race. To avoid being DSQ'd from sprint qualifying they have to change the rear wing, which means breaking parc ferme and that requires starting from the pit lane. Oh dear oh dear.

But “trying to push something” between the mainplane and flap would constitute a bit more than touching a competitors car.
