The level of proof and stinginecy of the rules aren't anywhere close to what they are in criminal trials.

Take schumacher for example, 2 title deciding collisons, Both times it was deemed a racing incident. However for the second one, 2 weeks after the fact Mosley decided a disciplinary hearing was needed, and threw schumacher out of the championship.

Thus as you can see the FIA has its own standards and they aren't always what people think they should be.

Mercedes May just take this however they may try and push this to the arbitration for sport and try and deal with it post race using tampered with evidence as a reasoning. That doesn’t require anything more than reasonable doubt to come into effect. It’s why evidence of any crime uses sealed bags, photo’s, chain of custody, etc ANY doubt and it’s inadmissible.
They may fail in that attempt but Verstappen has caused this grey area without his intervention is a slam dunk DQ

Thats pure speculation on your part. The video is grainy as hell when trying to get a closer look.
I’ll say it again. There is a very good reason why nobody is allowed to touch evidence at all. ‘I only used my hand to measure’ wouldn’t cut it as an excuse because it still creates reasonable doubt. Verstappen had no business touching it at all and he has created any leverage Mercedes now possibly has.

It probably didn’t but has been said above, Max’s actions have now bought an element of doubt into the equation which is an angle I’m sure Mercedes will be trying to work.

I’m sure they will but it is a silly defense and easy to dispute. On the other hand, the FIA has proven to do anything to save the championship.
